Add a regression test for the warning fix.

This PR adds no regression test. docs/develop.md requires tests for fixes. (raw.githubusercontent.com) Add a test that runs the built CLI with --pending-deprecation --throw-deprecation and checks that startup succeeds without DEP0040.
