+Nintendo is also the exclusive owner of the Animal Crossing logos and related designs. Nintendo has acquired trademark rights in these designs due to Nintendo’s long-standing and high-profile use of the designs in connection with Nintendo’ products and services. Attached as Exhibit B are examples of Nintendo’s protected Animal Crossing logo designs.

+The reported repository displays Nintendo’s intellectual property without permission on its main page, including Nintendo’s Animal Crossing characters and imagery and a logo designed to mimic Nintendo’s Animal Crossing logo designs, in connection with the distribution of a UI component library. The component library itself contains multiple instances of unauthorized copies of Nintendo’s copyright-protected Animal Crossing characters and imagery. This unauthorized display and distribution of Nintendo’s intellectual property violates Nintendo’s rights under the Copyright Act (17 USC § 501) and the Lanham Act (15 USC § 1125).
